Welcome to Parlour! These Terms and Conditions (“Terms”) govern your access and use of our platform, services, and website (collectively, the “Platform”). By using the Platform, you agree to these Terms. If you do not agree, do not use Parlour.

1. Nature of Parlour’s Services

  1. Parlour acts as a third-party platform that connects independent artists (“Artists”) with clients (“Clients”). Parlour does not provide artistic services and is not responsible for the work, conduct, or outcomes of services provided by Artists.

  2. Parlour does not represent or act as an agent, partner, employer, or affiliate of Artists or Clients. The relationship between Artists and Clients is independent and governed solely by their direct agreement.

2. No Payment Processing or Refunds

  1. Parlour does not process payments, collect fees, or facilitate financial transactions between Artists and Clients. Any payment disputes, refunds, or claims must be resolved directly between the Artist and the Client. Parlour disclaims all liability related to payments or financial arrangements made through or outside the Platform.

3. No Vetting or Verification

  1. Parlour does not vet or verify the professional qualifications, licenses, certifications, or backgrounds of Artists. Artists are solely responsible for complying with applicable laws and regulations, including licensing and permitting requirements.

  2. Parlour does not verify the age, identity, or legal eligibility of Clients. It is the responsibility of Artists to confirm that their services comply with applicable age, consent, and legal requirements.

4. Consent Forms and Legal Compliance

  1. Parlour does not manage, provide, or retain consent forms or other documentation required for appointments. Artists and Clients are responsible for obtaining and retaining any necessary consents, releases, or agreements related to services provided.

  2. Parlour is not liable for any failure by Artists or Clients to comply with laws, regulations, or consent requirements.

5. Disclaimer of Liability

  1. Parlour is not liable for any loss, injury, damage, or dispute arising from interactions between Artists and Clients or the services provided by Artists.

  2. Parlour is not responsible for any misconduct, negligence, or breach of agreement by Artists or Clients. All disputes must be resolved directly between the parties involved.

6. Data Collection and Use

  1. Parlour may collect and retain personal data provided by Artists and Clients, including contact information and other relevant details.

  2. Parlour may use this data for internal purposes, including marketing, research, and improving the Platform. By using Parlour, you consent to Parlour’s collection and use of data in accordance with our Privacy Policy.

  3. Parlour may share personal data with affiliates, business partners, and third parties, where legally permissible, to enhance the services provided through the Platform.

7. User Responsibilities

  1. Users of Parlour, whether Artists or Clients, must act in good faith, respect the rights of others, and comply with all applicable laws and regulations.

  2. Artists are solely responsible for maintaining professional standards, obtaining necessary licenses, and ensuring compliance with applicable health, safety, and legal requirements.

  3. Clients are responsible for accurately representing their eligibility and complying with any requirements imposed by the Artist.

8. Intellectual Property

  1. All content, trademarks, and materials on the Platform are owned or licensed by Parlour and are protected under intellectual property laws. Users may not copy, reproduce, or distribute content from the Platform without prior written consent from Parlour.

9. Indemnification

  1. You agree to indemnify and hold harmless Parlour, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of:

  2. Your use of the Platform;

  3. Your violation of these Terms; or

  4. Any disputes or agreements between you and another user, including Artists and Clients.

10. Limitation of Liability

  1. Parlour is not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the Platform or these Terms.

  2. Parlour’s total liability under these Terms, if any, is limited to the amount of fees, if any, you paid directly to Parlour for using the Platform.

11. Termination and Suspension

  1. Parlour reserves the right to suspend or terminate access to the Platform for any user who violates these Terms, engages in misconduct, or for any other reason at Parlour’s sole discretion.

  2. Upon termination, your rights under these Terms will immediately cease.

12. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of Great Britain and Northern Ireland..

  2. Any dispute arising from these Terms will be resolved exclusively in the courts of Great Britain and Northern Ireland.

13. Amendments

  1. Parlour may update or amend these Terms at any time. Updated Terms will be posted on the Platform with an updated “Effective Date.” Your continued use of the Platform constitutes acceptance of the updated Terms.
